New offences of causing death or serious injury by dangerous, careless or inconsiderate cycling – Parliament passes Bill to introduce 3 new offences, implementing a system to bring irresponsible cyclists, committing these serious offences, to account.
The Road Traffic Offences Cycling Bill has been passed through Parliament and introduces three new offences relating to cyclists causing death or serious injury.
Maximum penalties for the new offences range from 14 years imprisonment, on indictment for causing death by dangerous cycling, to fines at the lower end of the sentencing spectrum.
Causing death by dangerous driving – RTA section 27A (a) – penalties include 14 years imprisonment on indictment meaning offences sentenced only at the Crown Court.
Causing serious injury by dangerous cycling. RTA Section 27B 35 maximum penalties include 12 months imprisonment when tried summarily, or on indictment, so at the Crown Court, 5 years or a fine or both.
Causing death by careless or inconsiderate cycling. RTA Section 27C months – (in Scotland) 6 months imprisonment if heard at the magistrates’ court, the statutory maximum of 12 months in England and Wales, or 5 years and/or a fine on indictment, at the Crown Court.
